Court Proceedings Update – Maligakanda Magistrate’s Court

The matter was taken up for hearing before the Magistrate’s Court of Maligakanda on 28th April 2025.

Senior Counsel Mr. Shiraz Noordeen appeared on behalf of the original complainants.

During the proceedings, Counsel for the accused raised an objection under Section 191 of the Code of Criminal Procedure, arguing that Counsel for the complainants was not entitled to conduct the trial and that a representative from the Attorney-General’s Department should be appointed for that purpose.

The learned Magistrate, in considering the objection, observed that the nature of the case requires a sound understanding of the Islamic faith to properly conduct the trial. Given that the Criminal Investigation Department (CID) had no objection to a private counsel leading the evidence of the prosecution witnesses, the learned Magistrate overruled the objection raised by the accused’s counsel and granted permission for Mr. Noordeen to continue conducting the prosecution.

The case has been re-fixed for further hearing on 25th August 2025.
